Making a joint application is the easiest way to get a divorce.
You both sign the divorce application.
The best part of a joint divorce is that there’s no need to serve any documents, because you are making the application together.
A sole divorce is more difficult.
Only you sign the divorce application.
However, with a sole divorce, you’re required to arrange for the paperwork to be served on your ex.
You’re also required to prepare and file service paperwork with the court.
Can’t find your marriage certificate?
You will need a copy of your marriage certificate.
You can’t get a divorce without it.
You can order a replacement copy online from your State/Territory Department of Births, Deaths & Marriages.
Don’t order a ‘Commemorative’ copy. The court won’t accept it.
If you were married overseas, you should contact the relevant office in the country where you were married.
If you get stuck, you could try the Consulate/Embassy.
Agreed on arrangements for children?
The court will only grant your divorce if it’s satisfied that proper arrangements are made for all children under 18 years.
This includes all children who were living with you at the time of separation.
We send you an quick form to complete with sample wording about everything that’s needed so all the required information is included in your divorce application.
Separated and still living in the same home?
If you’ve spent part or all of the last 12 months living in the same home, there are extra things you’ll have to have to do to get a divorce.
We’ll provide you with detailed information and a sample affidavit showing exactly what’s required.
